Good Standing & Co. ("Good Standing & Co.," "we," "us," or "our") provides mobile notary services and mortgage licensing compliance consulting to individuals, mortgage professionals, and mortgage companies. This Privacy Policy explains what personal information we collect, how we use it, when we share it, and the choices you have. It applies to our website, our client intake and scheduling process, our notarial services, our licensing compliance consulting services, and our email, phone, and SMS communications.
By using our website or engaging our services, you agree to the practices described in this policy. If you do not agree, please do not use our website or services, and contact us with any questions before providing personal information.
Good Standing & Co. is a Michigan based mobile notary and mortgage licensing compliance consultancy. Depending on the engagement, our services may include performing notarial acts (such as acknowledgments, jurats, oaths, affirmations, and witnessing signatures) as a commissioned Michigan notary public, and advising mortgage companies and mortgage loan originators on state and federal licensing compliance, including matters connected to the Nationwide Multistate Licensing System (NMLS) and applicable state notary law.
Because of the nature of these services, we sometimes collect and handle sensitive identifying information. We take that responsibility seriously and describe below exactly how that information is handled.
We collect information directly from you, automatically through our website, and from the mortgage companies, individuals, or agencies you authorize us to work with on your behalf.
We do not knowingly collect any personal information beyond what is reasonably necessary to schedule, perform, and document our notarial or compliance consulting services.
We use the information we collect to:
We do not use your information for automated decision making that produces legal or similarly significant effects, and we do not sell your personal information.
Good Standing & Co. performs notarial acts in accordance with the Michigan Law on Notarial Acts, Act 238 of 2003, as amended (MCL 55.261 et seq.). This law requires us to handle certain information in specific ways, including the following.
Identity verification. Before performing a notarial act, Michigan law requires the notary to verify the identity of each signer through personal knowledge or satisfactory evidence, such as a current government issued photo identification, or, for remote online notarizations, through an approved credential analysis and identity proofing process.
Journal of notarial acts. If we perform notarial acts using a remote electronic notarization platform, Michigan law requires us to keep a journal recording the date, time, and nature of each notarial act, a description of the record, the full name and address of each signer, the method used to verify identity, and any fee charged. We retain this journal for at least ten years after the notarial act, as required by law.
Audio and visual recordings. If a notarial act is performed using a remote electronic notarization platform and involves an audio or visual recording, we will disclose this to you and obtain your consent beforehand, as required by law. Any such recording is retained for at least ten years after the notarial act.
General notarial records. For notarial acts that are not performed electronically, Michigan law requires that records of the notarial act be maintained for at least five years.
Regulatory access. Michigan law authorizes the Michigan Secretary of State to request copies of notarial records and to inspect them as part of regulatory oversight. We will comply with such lawful requests.
We do not use the identification information collected for notarization purposes for any purpose beyond what the law requires and what is necessary to complete your notarial act.
When we provide mortgage licensing compliance consulting, we may handle information that relates to NMLS registration, license status, sponsorship, and related regulatory matters. This information is used solely to support the compliance engagement you have retained us for, such as preparing correspondence, addendums, or filings on behalf of you or the mortgage company you are affiliated with.
Information submitted to the NMLS by you, your employer, or on your behalf becomes subject to the NMLS's own privacy practices and applicable federal law, including the SAFE Act and the Consumer Financial Protection Bureau's Regulation G. We encourage you to review the NMLS's own privacy notice for details on how information submitted directly to that system is used and disclosed. Good Standing & Co. is not the NMLS and does not control how the NMLS or federal or state regulators use information once it has been submitted to their systems.
We do not sell your personal information. We share information only in the following circumstances.
We do not share mobile phone numbers or SMS opt in consent with any third party for marketing or promotional purposes. See the SMS Terms and Privacy section below for the specific commitments that apply to text messaging data.
